NYSDEC implements and enforces these legislative mandates, which are the fundamental source of the department's powers. Regulations are drafted by experts in environmental or natural resource fields, with input from the regulated community and the general public. NYSDEC presents all proposed regulations for public comment, a process that often includes public hearings. After revisions in response to the comments, the regulations are officially promulgated and their provisions acquire the force of law.</othercit>

            <abstract>This data set provides the water quality classifications of New York State's lakes, rivers, streams and ponds, collectively referred to as water bodies. All water bodies in the state are provided a water quality classification based on existing, or expected best usage, of each water body or water body segment. Under New York State's Environmental Conservation Law (ECL), Title 5 of Article 15, certain waters of the state are protected on the basis of their classification. Streams and small water bodies located in the course of a stream that are designated as C (T) or higher (i.e., C (TS), B, or A) are collectively referred to as "protected streams."For more information see https://www.dec.ny.gov/chemical/23853.html1. The public should not make any business decisions and/or financial commitments based on the water quality classification data until they have secured the necessary permissions from the Department of Environmental Conservation. 2. The NYSDEC asks to be credited in derived products. 3. Secondary distribution of the data is not allowed. 4. Any documentation provided is an integral part of the data set. Failure to use the documentation in conjunction with the digital data constitutes a misuse of the data. 5. Although every effort has been made to ensure the accuracy of information, errors may be reflected in data supplied. The user must be aware of data conditions and bear responsibility for the appropriate use of the information with respect to possible errors, original map scale, collection methodology, currency of data, and other condition.</abstract>
            <purpose>The Water Quality Classifications are used for regulatory and planning purposes in order to protect and enhance the quality of New York State's waters.</purpose>
            <supplinf>1. These digital water quality classifications are an unofficial version of the State's water quality classifications. For the official version please refer to Title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York (6NYCRR) Part 800 et seq. ( http://www.dec.ny.gov/regulations/regulations.html ). The water quality classifications have been developed by the Department of Environmental Conservation, Division of Water from the most current sources available. Where there were inconsistencies in the maps the most current representation has been used. These data have not been submitted to the Department of State and they are not official classifications. However, they are largely consistent with the official regulations. Therefore, the public should not make any business decisions and/or financial commitments based on the water quality classification data until they have secured the necessary permissions from the Department of Environmental Conservation. 2. Water bodies that are not represented in this data set always have classifications unless they are excluded from classification in 6NYCRR, usually because they are located in a forest preserve. Please refer to the "Special Conditions" in 6NYCRR Chapter X (parts 800-941) for specific information. In MOST cases, the following will apply: water bodies that are not represented in this data set and have flow all year (perennial flow) have the classification of the water body they flow into; water bodies that are not represented in this data set and have flow only seasonally (intermittent flow) have a classification of "D." Since it may be difficult to determine if a water body has perennial or intermittent flow, please contact your DEC Regional Office if there is any doubt. DEC has the final authority to determine if a waterbody has perennial or intermittent flow. 3. For additional information about NYSDEC's Water Quality Classification program, please see the Water Quality Standards and Classifications page on the NYSDEC web site ( http://www.dec.ny.gov/chemical/23853.html ). 4. This data set should be used to identify water quality classifications only; it is not a complete representation of water bodies. The USGS high-resolution National Hydrography Dataset (NHD) should be used along with this data set to see a more complete representation of water bodies (see http://nhd.usgs.gov ). 5. This data set includes a line and a polygon layer. Most water bodies, including most lakes and ponds along the stream network, are represented in the line layer. Lakes and ponds along the stream network are represented by flow lines (sometimes called centerlines) drawn through lakes and ponds to connect flow in a linear network. Isolated lakes and ponds, and other features difficult to represent with flow lines (such as coastal waters), are represented in the polygon layer. The NHD should be used along with this data set to see the polygons for lakes, ponds and large streams. 6. Water body features (lines and polygons) are based on the NHD whenever possible. Where water body features are not found in the NHD, or are significantly different than described by 6NYCRR and associated maps, they were digitized using visual estimation based on information from 6NYCRR and associated maps. 7. In some instances this data set may indicate assignment of classifications for waters contained within the boundaries of the State-owned forest preserve lands and, therefore, controlled under the provisions of the State Constitution and the Conservation Law. Such waters are excluded from classification to the extent that any part of such waters may be located within the boundaries of the State-owned forest preserve lands. All waters within 100 feet of the boundaries of the State-owned forest preserve lands shall be assigned to class A with standards of quality and purity for class A.</supplinf>

                <srccontr>NHD stream reaches were used to develop (ESRI software) linear event tables that provide the linear extent of the lakes, rivers, streams and ponds.</srccontr>

                <procdesc>The NHD was visually compared with the paper maps associated with 6NYCRR (WIN maps). Water bodies that could be identified both in the NHD and on the 6NYCRR maps were assigned the part number and item number of the water bodies found in the text of 6NYCRR. This was done using linear referencing in the case of linear features (most) and a related table for polygon features. Water bodies found on the 6NYCRR maps but not found in the NHD were digitized using visual estimation and stored in separate shape files. These water bodies were also assigned the part number and item number from 6NYCRR. The data was reviewed by NYSDEC staff for consistency with 6NYCRR. Any errors found were corrected and the data was re-reviewed. This process is ongoing.</procdesc>

All water bodies in the state are provided a water quality classification based on existing, or expected best usage, of each water body or water body segment. Under New York State's Environmental Conservation Law (ECL), Title 5 of Article 15, certain waters of the state are protected on the basis of their classification. For the official version please refer to Title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York (6NYCRR) Part 800 et seq. ( http://www.dec.ny.gov/regulations/regulations.html ). The water quality classifications have been developed by the Department of Environmental Conservation, Division of Water from the most current sources available. Where there were inconsistencies in the maps the most current representation has been used. These data have not been submitted to the Department of State and they are not official classifications. However, they are largely consistent with the official regulations. Therefore, the public should not make any business decisions and/or financial commitments based on the water quality classification data until they have secured the necessary permissions from the Department of Environmental Conservation. 2. Water bodies that are not represented in this data set always have classifications unless they are excluded from classification in 6NYCRR, usually because they are located in a forest preserve. Please refer to the "Special Conditions" in 6NYCRR Chapter X (parts 800-941) for specific information. In MOST cases, the following will apply: water bodies that are not represented in this data set and have flow all year (perennial flow) have the classification of the water body they flow into; water bodies that are not represented in this data set and have flow only seasonally (intermittent flow) have a classification of "D." Since it may be difficult to determine if a water body has perennial or intermittent flow, please contact your DEC Regional Office if there is any doubt. DEC has the final authority to determine if a waterbody has perennial or intermittent flow. 3. For additional information about NYSDEC's Water Quality Classification program, please see the Water Quality Standards and Classifications page on the NYSDEC web site ( http://www.dec.ny.gov/chemical/23853.html ). 4. This data set should be used to identify water quality classifications only; it is not a complete representation of water bodies. The USGS high-resolution National Hydrography Dataset (NHD) should be used along with this data set to see a more complete representation of water bodies (see http://nhd.usgs.gov ). 5. This data set includes a line and a polygon layer. Most water bodies, including most lakes and ponds along the stream network, are represented in the line layer. Lakes and ponds along the stream network are represented by flow lines (sometimes called centerlines) drawn through lakes and ponds to connect flow in a linear network. Isolated lakes and ponds, and other features difficult to represent with flow lines (such as coastal waters), are represented in the polygon layer. The NHD should be used along with this data set to see the polygons for lakes, ponds and large streams. 6. Water body features (lines and polygons) are based on the NHD whenever possible. Where water body features are not found in the NHD, or are significantly different than described by 6NYCRR and associated maps, they were digitized using visual estimation based on information from 6NYCRR and associated maps. 7. In some instances this data set may indicate assignment of classifications for waters contained within the boundaries of the State-owned forest preserve lands and, therefore, controlled under the provisions of the State Constitution and the Conservation Law. Such waters are excluded from classification to the extent that any part of such waters may be located within the boundaries of the State-owned forest preserve lands. All waters within 100 feet of the boundaries of the State-owned forest preserve lands shall be assigned to class A with standards of quality and purity for class A.</suppInfo>

                <stepDesc>The NHD was visually compared with the paper maps associated with 6NYCRR (WIN maps). Water bodies that could be identified both in the NHD and on the 6NYCRR maps were assigned the part number and item number of the water bodies found in the text of 6NYCRR. This was done using linear referencing in the case of linear features (most) and a related table for polygon features. Water bodies found on the 6NYCRR maps but not found in the NHD were digitized using visual estimation and stored in separate shape files. These water bodies were also assigned the part number and item number from 6NYCRR. The data was reviewed by NYSDEC staff for consistency with 6NYCRR. Any errors found were corrected and the data was re-reviewed. This process is ongoing.</stepDesc>
